Congratulations to Florida Farm Bureau in obtaining a Motion for Directed Verdict in favor of their policyholder in a third party liability defense matter in Indian River County Circuit Court. Specifically, Plaintiff alleged that Defendant homeowner was vicariously negligent for the purported agent’s failure to supervise and provide proper safety equipment to Plaintiff. Plaintiff fell off the roof of Defendant homeowner’s barn and sustained significant injuries to his ankle. Plaintiff rested its case after two days of trial and the Court granted Defendant’s Motion for Directed Verdict on the third day finding that Plaintiff had not shown that the purported agent was negligent, nor that the purported agent was an agent.
